THE AVOIDABLE RECKLESSNESS GPGC JUDGEMENT DEBT OF $170M...



We all woke to the insanely unpleasant news of Ghana being slapped with an elephant yet unthinkable amount of $170million as judgement debt and while most of us (I mean, the discerning non-spectators) were struggling to come to terms with this crazy judgement debt, and how it all came about, the man (GHANA's A.G) who represented Ghana in the suit and lost embarrassingly and shamefully, came home and to him, the only face saving tent is to deliberately, and shamelessly draw  the NDC into this needless lost because to him, majority of Ghanaians are so daft that they can't think critically and read in between the lines proper, and again,to him, most Ghanaian journalists aren't patient to read the full judgement, the letter of termination and look for authentic documents (and not unsigned suppose PPA committee report), to properly shaped the public discords and views. How much less the husler man in the street looking for "nokofio"??.

It is sad, depressing, stinking and embarrassing watching and listening to most Ghanaian journos.


Now, let's ask these fundamental yet basic pointing questions,


1. Was the judgement given on the basis of how  necessary/unnecessary or how lobe sided the contract (GPGC) was entered into? With facts available before us, big NO is the answer.


2. Or was Ghana being slapped with this judgement debt based on how wrongful this contract was aborted? With enormous available facts at hand, YES is the obvious(the international court of arbitration judgement said it all).


3. Who wrongfully terminated the contract and under whose blessing (advice/counsel)?


4. On what basis was the contract terminated? If you want to know, get the termination letter issued by then energy minister, Mr Boagye Agyarko.


5. Was Ghana gov't so naïve about the GPGC suit or GoG was simply reckless and clueless?


6. After the first judgement was given, what barred gov't from appealing within the 28day window and even after the magnanimity extension of days?


7. During the late appeal, why did the AG choose to tender in a redacted PPA report to the international tribunal court as posited by the venerable law Professor, Prof. Kwaku Azar and as equally said in the judgement delivered?


8. What's embedded in the unredacted(unedited) supposed PPA report that our AG is so much afraid of that he couldn't adduce it in defense of Ghana, even when the international tribunal court requested that the unedited supposed PPA report be tendered in?

9. Those journalists running to town with trumpet glued to their mouth bursting our ears with a supposed PPA report asking for termination of EPAs and PPAs, were the said report signed??

10. As a journalist, don't you think it is proper to pause to query why the report weren't signed??

11. The people that sent this supposed PPA report to you journalists, have they(senders) added any official letter appointing Mr Ahenkra and the terms of reference to Mr Ahenkra to chair the said committee to review PPAs?? Or that isn't important to you as a journalist??

Or Ghana is on autopilot where person(s) can just be asked by mouth to carry out such important exercise that comes with sitting allowances from the tax payer??

12. For the past 3days, we hear the NPP and most uninformed journalists bark about excess capacity charges, were excess capacity charges one of the basis mentioned in the Agyarko's termination letter to GPGC??


In opposition, these guys (NPP) accused the then gov't (JM gov't) of  incompetence and bad governance.

But today, we are being told that, they (the competent NPP) came to power and saw one supposed report that was commissioned by the "incompetent JM gov't" and they, the competent NPP gov't with the AG having read the report, gave its legal blessing to then energy minister, Mr Boakye Agyarko, to abort this GPGC contract and today Ghana is being asked to pay $170million yet, discerning non-spectators like me and you must clap for them for having done a yeoman's job and rather slaughter the previous gov't for this dubious criminal recklessness.

Wow, what an intelligent smart people!

What a competent people Indeed!!


But these same NPP guys made nauseating stinking noise about these PPAs contracts of   producing so-called excess power and that they will terminate many of them if come to power. Meanwhile same people via the energy minister Mr Mathew Opoku Prempeh said Ghana needs more generation capacity. Same Nana Addo-NPP GOVT came and extended the life period of AKSA(from 5-10years), KARPAWA(10-20years), etc(same people that are telling you and i that JM govt sadled Ghana with too many PPAs oo yet they extending the life span of same PPAs!)

 Now, they came to power, and to prove their hollow noises, they aborted this contract without any merit and today, Ghana is paying the price and instead of these guys being sober and beg Ghanaians for clemency, they are rather calling us (Ghanaians) dummies.


Ghana journos, please strive to always read documents, look for the right information and ask questions that will prove your difference from my illiterate Grandpa under the mango tree.

You can do better than this arm chair journalism.

Gosh.
